The persecution and injustice suffered by Sherry Chen has entered its tenth year.;xNLx;;xNLx;Her job at the National Weather Service was to predict floods to save American lives and properties in the Ohio River Valley.;xNLx;;xNLx;However, she was alleged of spying for China, fired from her job, and denied returning to her work even after a decision by the Merit Systems Protection Board.;xNLx;;xNLx;It is a story that she would never have imagined could happen to her, but it did. It is a story that she would never have believed could take place in this country, but it is playing out right now.​​

The Informant

Deborah H. Lee at the U.S. Army Corps of Engineers (USACE) reported Sherry Chen, an employee of the National Weather Service (NWS) as a “Chinese National” for security allegations to the USACE Security Office.

7-Hour Interrogation

Two Department of Commerce (DOC) investigative agents interrogated Sherry Chen for 7 hours without informing her that she was the target of investigation and without the presence of legal counsel.

National Oceanic and Atmospheric Administration (NOAA), an agency within DOC overseeing the National Weather Service, announced the promotion of Deborah Lee into a Senior Executive Service position.

Laura Furgione, Deputy Director of National Weather Service (NWS) and fourth level supervisor to Sherry Chen, initiated proposal to terminate Sherry Chen’s employment at NWS.

Change of Deciding Official

Louis Uccellelli resigned his role as the DOC deciding official after Sherry Chen and her lawyer Peter Zeidenberg presented both written and oral appeal against the proposal. Michael Devany was named the new deciding official.

Sherry Chen Fired

Sherry Chen was fired from her job despite a second appeal from her and Peter Zeidenberg to Michael Devany, Sherry Chen's sixth level supervisor, about the flaws and errors of the proposed disciplinary action. In subsequent MSPB hearings, it was revealed that Michael Devany had announced his retirement from DOC during the second week of January 2016.

MSPB Chief Administrative Judge Michele Szary Schroeder issued a 135-page blockbuster decision, concluding that Sherry Chen was a victim of “gross injustice,” reinstating Sherry to her job with back pay and benefits. The judge also found multiple levels of DOC mishandled the Sherry Chen case.

The Sherry Chen Legal Defense Fund notified the Senior Executives Association (SEA) about the MSPB decision and the role of Laura Furgione, a member of the Board of Directors of SEA.

Congressional Press Conference Held

A press conference was held in the House Cannon Building. The Congressional Asian Pacific American Caucus (CAPAC) sent a letter to DOC Inspector General requesting a full and independent investigation of DOC’s handling of the Sherry Chen case. Over 130 organizations announced a joint letter to Commerce Secretary Ross to comply with the MSPB decision and support CAPAC call for an IG investigation.
