Second Circuit Finds in Favor of Viacom, Remands

The Second Circuit Court of Appeals found in favor for Viacom in the case of Viacom v. YouTube. However, it's finding was only that YouTube could be liable for any infringing content that it was "willfully blind" towards, and made it clear that YouTube did not have a duty to monitor user activity. Additionally, the court found that YouTube could be liable if it had exerted "substantial influence" on users' infringing activities. Wall Street Journal Finds YouTube Recommends Extremist Content
